The Florida law regarding relocating children who may be the subject of a custody or visitation order changed in October of 2006. Because the law is so new, few attorneys have handled many relocation cases where one parent wants to move away from the children's primary residence.

Parents who do not realize that the law has changed can be subject to legal penalties if they do not follow the new process. They may lose custody, be required to pay attorneys' fees and subject the child to upheaval and uncertainty. Failure to comply with the law may damage a parent’s position in future litigation involving custody or visitation.

The Law Regarding Relocation

The parent with primary custody of a minor child has to serve the other parent with a notice of intent to relocate prior to the intended relocation. The other parent then has 30 days during which he or she can contest the notice.

If there is an objection to the relocation notice, the parent who wishes to move away must then file a lawsuit. The new law applies to moves of more than 50 miles away from the principal place of the children's residence.
